HONOURABLE JUSTICE G. SRI DEVI I.A.NOs.2 AND 3 OF 2020 IN/AND CRIMINAL PETITION NO.493 OF 2020 COMMON ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of proceedings in S.C.No.503 of 2016 on the file of the Special Sessions Judge for Fast Tracking the cases relating to Atrocities against Women-cum-VII Additional District and Sessions Judge at Karimnagar.
Though the present Criminal Petition is filed seeking quashing of the entire proceedings, learned counsel for the second respondent/de facto complainant filed I.A.Nos.2 and 3 of 2020 seeking permission to compromise the matter and to compound the offences for quashing the charge sheet in S.C.No.504 of 2016 respectively.
Since the offences alleged against the petitioner/accused are under Sections 420 and 376 of the Indian Penal Code, it is not permitted to compromise the matter and to compound the offences. Hence, the second respondent/de facto complainant sought permission to withdraw I.A.Nos.2 and 3 of 2020. Permission is accorded and I.A.Nos.2 and 3 of 2020 are dismissed as withdrawn.
Learned counsel for the petitioner/accused restricts his prayer seeking speedy disposal of the above said S.C. A further prayer has been made by the learned counsel for the petitioner/accused that during the pendency of the said Sessions Case, due to non-
appearance of the petitioner/accused, an order has been passed by the trial Court directing to issue non-bailable warrant (NBW) against the petitioner/accused on 12.07.2018.
Having regard to the facts and circumstances of the case and since the Sessions Case pertains to the year 2016 and to meet the ends of justice, the order dated 12.07.2018 issuing NBW against the petitioner/accused is set aside and the petitioner/accused is directed to surrender before the trial Court within a period of one week from the date of receipt of a copy of this order. On such surrender, the trial Court is directed to enlarge him on bail on his furnishing a personal bond for a sum of Rs.15,000,0/- (Rupees fifteen thousand only) with two sureties for a like sum each to the satisfaction of the said Court. It is further directed that the petitioner/accused shall appear personally before the trial Court on each and every date of adjournment till the conclusion of trial.
In case the conditions imposed by this Court are not complied with by the petitioner/accused, the trial Court is at liberty to proceed against him in accordance with law. Further, the learned Special Sessions Judge for Fast Tracking the cases relating to Atrocities against Womencum-VII Additional District and Sessions Judge at Karimnagar, is directed to dispose of S.C.No.503 of 2016, as expeditiously as possible, preferably within a period of two (2) months from today, without giving any unnecessary adjournments.
With these directions, the Criminal Petition is disposed of. Miscellaneous applications, if any, pending shall stand closed. _________________ (G. SRI DEVI, J) 13th February 2020 RRB
