THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.11968 OF 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for respondents 1 to 4.
2. Petitioner has filed this Writ Petition seeking a direction to respondents 1 to 4 to cancel sale deed executed on 19.02.2015 by the petitioner's father in favour of respondent No.5.
3. There cannot be unilateral cancellation of any sale deed as per the decision of Supreme Court of Indian in Thota Ganga Laxmi v. Government of Andhra Pradesh[1]. In view of the same, this Writ Petition is misconceived and the same is liable to be dismissed.
4. The Writ Petition is accordingly dismissed giving liberty to the petitioner to approach a competent civil Court seeking cancellation of the sale deed dated 19.02.2015. There shall be no order as to costs.
5. As a sequel, the miscellaneous petitions, if any, pending, shall stand closed.
