THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1531 of 2019 O R D E R:

This Writ Petition is filed for the following relief: "....to issue a writ or order or direction or writ of Mandamus declaring the action of the 2nd respondent rejecting the application submitted for building permission in the name of short fall stating that survey number is kept in prohibited list through letter No.3/C21/17525/2018 dated 26.09.2018 submitted by the petitioner in respect of the land admeasuring 230 square yards of house plot bearing No. B-III/202 in Sy.No.44/4 situated at B.K.Enclave, Maktha Mahabubpet Village, Serilingampally Mandal, Ranga Reddy District as bad, illegal, arbitrary, malafide, intentional and without any power and authority and consequently set-aside the same as illegal in the interest of justice ...."

When the matter is taken up, it is submitted by the learned counsel for the petitioner as well as learned Standing Counsel for respondent No.2 that the issue raised in the present Writ Petition is squarely covered by the common order dated 06.08.2019 passed by this Court in Writ Petition No.12013 of 2019 and batch. Relevant portion of the aforesaid order reads as under: "Therefore, all the writ petition are disposed of directing the respondent Corporation to process the building permission applications submitted by the petitioners without insisting for securing NOCs from the Revenue Department, if basis of such mandate by the GHMC was on the ground that Survey No.44/4 of Maqta Mahaboobpet Village, Serilingampally Mandal, Ranga Reddy District, is included in the Gazette Publication of Ranga Reddy District, dated 26.09.2013.

If there is any other objection for granting building permission, the same shall be informed to the petitioners.

Following the aforesaid common order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof.
