ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.4 in Crime No.570 of 2025 before the Patancheru
Police Station, Sangareddy District, registered for the offences punishable under Sections 85 and 108 read with 3(5) of BNS. 2.
The brief facts of the case are that a complaint lodged on 30.06.2025 alleging that the complainant's daughter, Neha Soni, who had performed a love marriage with accused No.1 on 30.12.2024, was subjected to continuous harassment by her husband and his family members, which allegedly led her to commit suicide by hanging on 28.06.2025 at Isnapur village. The complainant alleged that the accused persons had threatened and harassed the deceased, forcing her to leave her husband or die. Based on the said complaint, Crime No.570 of 2025 was registered by Patancheru Police for the above said offences, and the petitioner was arrayed as accused No.4.

Heard Sri Mohd. Islamuddin Ansari, learned counsel appearing on behalf of the petitioner as well as Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner, who was the cousin brother-in-law of the deceased, had no role in the matrimonial life of the deceased and accused No.1 and was residing separately in his native place. He contended that the petitioner was falsely implicated without any specific allegations, that the investigation was substantially completed, and that his custodial presence was no longer required. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal petition.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, stating that there are serious allegations against the petitioner and that he also instigated accused No.1 to harass the deceased. He further submitted that an earlier complaint had also been filed against the petitioner by the de facto complainant and, as such, custodial interrogation of the petitioner is necessary. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by the learned counsel on either side and upon a perusal of the material available on record, it appears that the petitioner is arrayed as accused No.4 and the allegation against him is that he instigated accused No.1 to harass the deceased, allegedly leading her to commit suicide. However, the prosecution case itself indicates that accused No.1 and the deceased were living separately and that the petitioner is a resident of the State of Madhya Pradesh. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions: i.
The petitioner shall surrender before the Station House Officer, Patancheru Police Station, Sangareddy District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the
Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
