THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.457 OF 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner alleges threat of dispossession by the Tahsildar, Malkajigiri Mandal, Ranga Reddy District, the 3rd respondent. However, I see no reason for the petitioner to approach this Court inasmuch he is already protected by an appropriate order passed by the III Additional District Judge (Fast Track Court), Ranga Reddy District, in A.S.No.210 of 2008, dated 27.10.2011, whereunder a permanent injunction was granted in favour of the petitioner restraining the respondents/defendants from interfering with his peaceful possession and enjoyment over the plaint schedule property until the petitioner/appellant is evicted by due process of law. In addition to that, the petitioner himself has filed a Memo, dated 06.11.
2015, issued by the Collector, Ranga Reddy District, the 2nd respondent, wherein also the 3rd respondent was directed to evict the encroacher with due process of law. Therefore, I do not see any reason for apprehension of the petitioner, when the order of the civil Court as well as the order of the 2nd respondent directs the 3rd respondent to follow due process of law and as on today no such proceedings are initiated against the petitioner. Hence, no orders are warranted in this Writ Petition.
The Writ Petition is accordingly dismissed. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
