...RESPONDENTS Petition Under Article 226 of the Consfitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction, more particularly one in the nature of a Writ of Mandamus declaring the action of respondent No 2 and 3 in seeking to reject the tender application of the petitioner for supply of Diet to the Area Hospital, Bhainsa, Nirmal District though the petitioner is the lowest tenderer and seeking to award the same to third party as arbitrary, unjust, illegal and against the principles of natural justice and in violation of Article '14 and 16 of the Constitution of lndia and consequently direct the respondents to award the diet contract to the petitioner for Area Hospital, Bhainsa, Nirmal District.

HON'BLE MRS JUSTICE SUREPALLI NANDA WRIT PETITION No.1487 OF 2023 ORDER:
The learned counsel appearing on behalf of the petitioner, brings on record, the letter dated 27.01.2023 addressed to the Registrar (Judicial), High Court for the State of Telangana, at Hyderabad, seeking the permission of the Court for withdrawal of the present writ petition on the ground that the petitioner in the W.P.No.14B7 of 2023 had instructed the learned counsel on record to withdraw the present writ petition. Permission is accorded.
Taking into consideration the contents of the letter dated 27.01.2023, and on request of learned counsel for the petitioner, the present writ petition is dismissed as withdrawn. However, there shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
