THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.1627 of 2014 ORDER:

The order, violation of which is alleged in this Contempt Case, is the order passed by this Court in W.P.No.2321 of 2014 dated 30.01.2014 whereby the District Collector, Chittoor was directed to consider the petitioner's representation, and communicate his decision to the petitioner, within one month from the date of receipt of the representation.

In the writ petition, the petitioner had questioned the inaction of respondents 3 to 8 in not providing a road from Komaragunta Village to Dalithawada of Komaragunta inspite of repeated representations, as illegal and arbitrary. In the affidavit filed in support of the contempt case, the petitioner has not stated whether he had submitted a representation, after this Court had passed the order violation of which is alleged in the Contempt Case. In the reply affidavit, the petitioner now claims that his repeated efforts to make a representation were of no avail, as nobody was willing to receive a copy of the said representation. Since no representation appears to have been submitted, the respondents cannot be faulted in not considering the petitioner's representation.

Be that as it may, the District Collector appears to have passed an order on 12.01.2017 rejecting the petitioner's request. In the absence of any representation being submitted, pursuant to the aforesaid order of this Court, the respondents cannot be said to have violated the order of this Court, much less wilfully and deliberately. We see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act.

The Contempt Case is, accordingly, closed.

Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs. _______________________________ (RAMESH RANGANATHAN, J) 27th July, 2018 JSU
