HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.15351 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Cr.P.C. to relax the condition imposed in Crl.M.P.No.889 of 2016 in PCS SC No.15 of 2016 on the file of I Additional Metropolitan Sessions Judge, Hyderabad for the offences punishable under Section 363 and 376 of I.P.C. and Section 6 of Protection of Children from Sexual Offences Act, 2012. As seen from the record, the I Additional Metropolitan Sessions Judge, Hyderabad while releasing the property i.e., Hero Honda Passion Pro Motor Cycle bearing No.A.P.29 BK 1204 imposed a condition of execution of self bond for an amount of Rs.25,000/- along with single surety for Rs.25,000/-.

Now it is contended that is onerous condition and it is difficult for him to produce a surety for Rs.25,000/-. But that is not a ground to relax such a condition since petitioner involved in serious heinous crime and in such a case, if the condition is relaxed, it is difficult to secure the motor cycle in question during trial.

Hence, I do not find any merit in this matter to relax condition imposed by the learned Sessions Judge and thereby this Criminal Petition is liable to be dismissed.

Accordingly, this Criminal Petition is dismissed. As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. _________________________________ JUSTICE M.SATYANARAYANA MURTHY Dated 28-10-2016.
