ORDER

It is the case of the petitioner that himself and his parents are having Ac.3-00 in R.S.No.116/3, which is converted into fish tank. To the east of the said tank, there is a small drainage and towards its north, there is a big drainage canal. When the 3rd respondent issued a notice on 2.6.2017 alleging that unauthorized construction was made on the drainage canal at K.M. 17.40 and asked him to remove the same, the present writ petition is filed.

A reading of the notice makes it clear that due to the said unauthorized construction, there is a danger for inundation of Gopavaram Village. Hence, the petitioner was asked to remove the said unauthorized construction in the Government land.

The petitioner states that he has nothing to do with the alleged unauthorized construction and the notice was issued only at the instance of his rivals.

This Court is not in a position to resolve the dispute and it is for the petitioner to submit a proper representation to the 3rd respondent bringing to his notice the correct facts and on consideration of the same, the 3rd respondent shall pass

appropriate orders or take action in accordance with law. If the petitioner has not made any unauthorized constructions in the Government land, the private land of the petitioner shall not be interfered with. However, this order will not prevent removal of unauthorized constructions in the Government land.
