THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.687 and 694 of 2024 COMMON ORDER:

These petitions are filed under Sections 437 and 439 of Cr.P.C by the petitioners/accused Nos.1 and 2 seeking to enlarge them on bail in connection with F.I.R No.1784 of 2023 dated 19.12.2023 on the file of the PS, L.B.Nagar, Rachakonda, registered for the offence under Section 8 (c) r/w 20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act.

Since both the Criminal Petitions are filed seeking regular bail in connection with the very same FIR, they are being disposed of by way of this common order. 3.

Heard learned counsel for the petitioners, learned Additional Public Prosecutor for the respondent-State and perused the record.

The police, L.B.Nagar arrested these petitioners having found both of them in possession of 2.323 Kgs of Ganja.

Learned counsel for the petitioners would submit that the quantity is less than commercial quantity and there are no criminal antecedents against the petitioners. 6.

Learned Additional Public Prosecutor would submit that there is another case registered against accused No.1, however, there are no criminal antecedents insofar as accused No.2 is concerned.

However, keeping in view that the quantity seized is less than commercial quantity, the petitioners are granted the relief of regular bail, subject to the following conditions:

1) The petitioners/accused Nos.1 and 2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to the satisfaction of the II Additional Metropolitan Magistrate, Ranga Reddy Distrct at L.B.Nagar.

2) The petitioners/accused Nos.1 and 2 after release shall appear before the concerned Station House Officer on every Monday and Wednesday at 10am for a period of four (04) weeks and thereafter, as and when required for the purpose of investigation.

3) The petitioners/accused Nos.1 and 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, both the Criminal Petitions are allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
