O R D E R
Pursuant to the docket order dated 2.1.2017, K.V.V.R.R.V. Prasad, Sub-Inspector of Police, Thotlavalluru Police Station, Vijayawada City, Krishna District, appeared in person with a counter affidavit, whereby stated as under:
"4. It is submitted that prior to the orders of this Hon'ble Court dated 25.7.2016 in W.P.No.24399/ 2016, basing on the complaint of one Musunuru Visweswara Rao @ Purna, a case was registered in FIR No.33/ 16, dated 3.3.2016 for the offences u/ s 341, 447, 506 read with 34 IPC against the petitioner (A-1) and 2 others; and also registered FIR No.61/ 16 dated 8.6.2016 basing on the complaint of one P.Subba Rao for the offences u/ s 447, 427, 506 read with 34 IPC against the petitioner (A-1) and 6 others; and also a case in FIR No.64/ 16, dated 24.6.2016 was registered basing on the complaint of one Aravapalli Siri Krishna, against the petitioner (A-1) and another. Apart from the above crimes, the Assistant Commissioner of Police, East Zone, Vijayawada City vide proceedings C.No.15/ H-S/ ACP.EZ/ 2016 dated 30.6.
2016, opened the suspect sheet (L & O) against the petitioner herein, as he is having a tendency to grab the others land and threatening them. The above mentioned are under investigation. Therefore, this respondent has never interfered with the civil rights of the petitioner, as alleged in the affidavit. All other allegations of the petitioner are not correct and specifically denied. Thus, this respondent has not interfered with the lands of the petitioner.
6. It is further submitted that basing on the complaint against the petitioner, the following cases are registered against the petitioner even after the interim order of this Hon'ble Court in W.P.No.24399/ 2016 dated 25.7.2016, wherein the investigation is in progress:
(i) FIR No.87, dt. 20.09.2016, u/ s 379 IPC, basing on the complaint of one K.Venkata Siva Rao.
(ii) FIR No.115, dt. 20.12.2016 u/ s 186, 353, 506 read with 34 IPC, basing on the complaint of A.Sunitha, Mandal Revenue Inspector, Thotlavalluru.
8. I submit that I have got highest respect for the orders of this Hon'ble Court and I have not violated the orders passed by this Hon'ble Court. If for any reasons, this Hon'ble Court considers that there has been any violation of the orders of this Hon'ble Court on my part, I submit that the same is not intentional or deliberate and I tender my unconditional apology for the same."
Keeping in view the statement made in the counter affidavit, I hereby discharge the respondent from the contempt proceedings and accordingly the contempt case is closed. No costs.
