Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed therein, the High Court may be pleased extend /grant bail in favour of the Petitioner/Accused No. 1 for a period of 3 months in S.C.No. 80 of 2017 on the file of the I Additional District and Sessions Judge, East Godavari District, Rajamahendravam arising out of Crime No. 201 of 2016 of Tuni Rural Police Station, Tuni, East Godavari District; The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Ch. Dhanamjaya, Advocate for the Petitioner and of Public Prosecutor(AP) on behalf of RespondentState, the Court made the following ORDER :- "This Criminal Petition is filed by the petitioner/A-1 under section 437 and 439 of Cr.P.C.
, seeking grant of bail to the petitioner, who is A-1 in Crime No. 201 of 2016 of Tuni Police Station, East Godavari district, registered for the offences punishable under section 8 [c] read with section 20 [b] [ii] [c] of Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Heard the learned counsel for the petitioner/A-1 and the learned Additional Public Prosecutor representing the respondent/State.
3. Sri Ch. Dhanamjaya, learned Senior Counsel for the petitioner/A-1 submits that earlier interim bail was granted to the petitioner, vide Crl.MP.No.12755 of 2017, dated 09/12/2017, in order to facilitate the registration pertaining to the petitioner. He now submits that the petitioner requires interim bail, in order to attend on his wife, who is ailing from uterine bleeding problem. The medical certificate is also produced with regard to the ailment of the wife of petitioner. Earlier while granting bail to this petitioner, the Court took into consideration the ailment of his wife also. Hence, the same can be taken as a ground for granting interim bail, if it is required. The medical certificate, dated 17/01/2018 and also the case sheet issued by the A.P. Vaidya Vidhan Parishad is also filed.
Hence, considering the fact that the wife of the petitioner has to undergo 'hysterectomy surgery' after blood transfusion, interim bail can be granted to the petitioner for a period of two months, commencing from 25/01/2018 to 25/03/2018. The petitioner is directed to be released on interim bail on 25/01/2018 on his executing a personal bond for Rs.10,000=00 [Rs. Ten Thousand only] with two sureties for a like sum each to the satisfaction of IAdditional District and Sessions Judge, East Godavari at Rajahmundry. After completion of the above interim bail period, the petitioner shall surrender before the Superintendent, Central Jail, Rajahmundry before 05:00 p.m., on 26/03/2018. Cond..2..
