THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.29094 OF 2011 DATED: 14.07.2015 Between:

Chopparapu David .. Petitioner And The State of A.P., Rep. by Principal Secretary, Home Department, Hyderabad, and others.

.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.29094 of 2011 ORDER:

The grievance of the petitioner was as to the maintenance of a rowdy sheet in his name on the file of Vetapalem Police Station, Chirala, Prakasam District.

The Sub-Divisional Police Officer, Chirala, furnished written instructions dated 07.07.2015 to the office of the learned Government Pleader for Home, wherein he stated that earlier the petitioner was involved in six criminal cases. However, the petitioner was bound over in three of them for good behaviour, two ended in acquittal while the last was compromised before the Lok Adalat, Chirala. He further stated that the rowdy sheet was extended up to 31.12.2015 and that if the petitioner submits a representation to the competent authority to close the rowdy sheet being maintained against him, such request would be considered in accordance with law.

As the petitioner is not involved in any criminal activity presently and no crime seems to have been registered against him after 2013, it is for the authority concerned to apply its mind and decide as to

whether continuance of the rowdy sheet in the name of the petitioner on the file of Vetapalem Police Station, Chirala, is still warranted. The writ petition is accordingly disposed of permitting the petitioner to approach the authority concerned, the Superintendent of Police, Prakasam District, with an appropriate representation seeking closure of the rowdy sheet opened in his name on the file of Vetapalem Police Station. In the event such a representation is made, the authority concerned shall apply its mind duly taking into account the fact that no crime has been registered against the petitioner after 2013 and pass a reasoned order, under due communication to the petitioner.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 14th July, 2015 IBL
