O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.1202 of 2025 of Raidurgam Police Station, Cyberabad Commissionerate, registered for the offence punishable under Section 69 of the BNS, 2023.

The brief facts of the case are that, on 23.10.2025, the de-facto complainant lodged a report before the police stating

- 2 - that she got acquainted with the petitioner herein in the month of April, 2025 and both used to communicate regularly through phone calls and chats. Later, in the month of June, 2025, he proposed her for marriage and the petitioner herein physically exploited her under the pretext of marriage and thereafter, she became pregnant in the month of October and the petitioner herein took her to the hospital and got her pregnancy terminated and thereafter, the petitioner herein not answered her calls and ignored her. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offence.

Heard Sri K. Sai Sri Harsha, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegation and there is no such refusal of marriage from the petitioner herein. It is further submitted that, even according to the complaint, there is no refusal from the petitioner of marrying the defacto complainant and he is in jail since 31.12.2025 and in

- 3 - fact, he was arrested on 29.12.2025 at Kolkata and the material part of the investigation was already completed and LWs 1 to 13 witnesses were already examined. It is further submitted that mother of the petitioner is in severe health condition. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegation leveled against him is serious in nature and he took her to the hospital and got her pregnancy terminated and he refused to marry her, therefore, he is not entitled for the bail and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 31.12.2025 and in fact, he was arrested on 29.12.2025 at Kolkata. Further, as seen from the record, LWs 1 to 13 witnesses were already examined. Considering the facts and circumstances of the case, the nature of the allegations, the

- 4 - stage of investigation, the duration of incarceration and also the health condition of petitioner's mother, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions:

i.

The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XIII Additional Judicial Magistrate of First Class, Ranga Reddy District, at Rajendranagar.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in Section

- 5 - 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
