THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.3201 OF 2017 ORDER:

The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed requesting to quash the First Information Report in Crime No.405 of 2016 of Saifabad Police Station, Hyderabad.

2. Though, Sri Rastrapal, learned counsel appearing on behalf of Sri M.R. Vara Prasad, learned counsel for the petitioner, requests for grant of time till 26.04.2017, the learned Additional Public Prosecutor for the State of Telangana would submit that the Investigating Officer, on completion of investigation, filed charge sheet on 24.03.2017 on the file of I Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, and hence, the present Criminal Petition becomes infructuous.

3. It is true, when charge sheet is filed, the present Criminal Petition, which is filed seeking to quash the First Information Report, becomes infructuous, as the relief has to be changed.

4. Hence, the present Criminal Petition is dismissed as infructuous giving liberty to the petitioner to move appropriate application at an appropriate time.

5. The learned I Additional Chief Metropolitan Magistrate, Nampally, is directed to consider the charge sheet and act in

accordance with law within seven (7) days from the date of receipt of a copy of this order.

6. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
