THE HON'BLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No. 3690 of 2014 P.C.:

Heard learned counsel for the parties.

This C.R.P. is against the following order, dated 09.10.2014: "Heard learned counsel for the petitioner. Issue urgent notice to respondent through Court and R.P. Call on 27.10.2014."

This order was passed on I.A.No.637 of 2014 in O.S.No.828 of 2014. Interim application is filed by the petitioner under Order 38 Rule 5 read with Section 151 of the Code of Civil Procedure seeking direction to the respondent to furnish security within time frame.

Learned counsel for the respondent submits that the respondent has already entered his appearance in the suit and that he has no objection for hearing of I.A.No.637 of 2014 within time frame. He, without prejudice to the rights and contentions of the respondent, further submits that till I.A.No.637 of 2014 is decided finally, the respondent shall not create any third party rights in the properties sought to be attached. His statement is recorded and accepted.

In view thereof, the C.R.P. is disposed of with direction to the Court below to dispose of I.A.No.637 of 2014 as expeditiously as possible and preferably within a period of six weeks from today. Consequently, miscellaneous petitions, if any, also stand disposed of.
