HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31125 OF 2016 ORDER:

This writ petition is filed declaring the action of the 2nd respondent in passing the Memo dated 30.07.2016 in Letter No.579/Z/75 without affording an opportunity to the petitioners to submit their case, as illegal and arbitrary. Learned counsel for the petitioner submits that no notice was issued to the petitioner before passing the impugned order.

Learned Assistant Government Pleader produced the written instructions addressed by the Revenue Divisional Officer, Sanga Reddy which goes to show that the petitioners have filed the reopening petition after a lapse of 40 years.

The only grievance of the petitioner is that they were not issued notice before passing the impugned order and even the written instructions produced by the learned Assistant Government Pleader also does not indicate that notice was issued to the petitioners before passing the impugned order.

In view of the same, on the sole ground of not issuing notice to the petitioners before passing the impugned order, the impugned order is set aside.

Accordingly, the writ petition is allowed and the 2nd respondent is directed to dispose of the application filed by the petitioner after issuing notice to petitioner in accordance with law. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
