HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO C.R.P. No.249 of 2018 ORDER:

Aggrieved by the order dt.08.01.2018 in I.A.No.547/2017 in O.S.No.120/2007 passed by the learned Junior Civil Judge, at Wanaparthy, dismissing the petition filed by the petitioner/plaintiff No.6 under Section 151 CPC to reopen the suit for the purpose of filing petition to amend the plaint for adding the consequential amendments in the plaint, the petitioner preferred the instant CRP. 2) Heard arguments of Sri D.L.Pandu, learned counsel for petitioner and Sri Avinash Desai, learned counsel for 1st respondent. 3) The petitioner/plaintiff No.6 has filed another C.R.P.No.248 of 2018 challenging the order dt.08.01.2018 in I.A.No.548 of 2017 in O.S.No.120 of 2007 passed by the learned Junior Civil Judge, Wanaparthy, in dismissing the petition filed by him under Order VI Rule 17 CPC r/w Rule 28 Civil Rules of Practice permitting him to consequentially amend the plaint pursuant to the order in I.A.No.159 of 2014.

4) Today, this Court vide its order dt.27.06.2018, dismissed the said CRP No.248 of 2018. Hence, the instant CRP, which is filed challenging the dismissal of petition to reopen the suit for the purpose of filing petition to amend the plaint, is also liable to be dismissed.

5) Accordingly, this Civil Revision Petition is dismissed. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
