HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.517 OF 2020 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.313 of 2019 on the file of the Judicial First Class Magistrate at Chennur, Adilabad District.
A charge sheet came to be filed against the petitioners/A-1 to A-22 for the offences punishable under Sections 353, 341 and 506 read with Section 34 of the Indian Penal Code. Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners/A-1 to A-22 restricts his prayer seeking dispensation of the presence of the petitioners/A-2 to A-22 before the trial Court on every date of adjournment.
The learned Public Prosecutor submits that since the identity of petitioners/A-2 to A-22 is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.
Having regard to the facts and circumstances of the case, the personal appearance of the petitioners/A-2 to A-22 in C.C.No.313 of 2019 on the file of the Judicial First Class Magistrate at Chennur, Adilabad District, is hereby dispensed with except on the dates when their presence is specifically required by the Court. With the above direction, the Criminal Petition is disposed of insofar as the petitioners/A-2 to A-22 are concerned. Insofar as
the first petitioner/A-1 is concerned, the Criminal Petition is dismissed.
Miscellaneous applications, if any, pending shall stand closed.
