Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the respondent No.2 in not awarding contract to the petitioner who is the lowest tenderer for the technical and financial bids opened on 24-02-2015 and 26-02-2015 respectively in respect of Tender Notice No.PDS2/Movt/FG 5(1)/Stage I Tenders/2015-16/TS, dated: 09-02-2015, Warangal and issuing Re-Tender Notice No.PDS2/Movt/FG 5(1)/Stage 1 Tenders/2015-16/TS, dated: 28-022015 for the same work is highly arbitrary, bad and illegal.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein, and order of High Court dated 09-032015 made herein upon hearing the arguments of Sri P. Prabhakar Reddy, Advocate for the Petitioner, GP for Civil Supplies (TG) for Respondent No.1, and Sri A.Ravinder Reddy, Standing Counsel for Respondent Nos 2 & 3, the Court made the following.
