This writ petition is filed challenging the action of the 4th respondent in issuing Charge Memo dated 08.05.2017 and consequential proceedings dated 28.06.2017 appointing the Inquiry Officer, along with letters dated 13.07.2017 and 30.06.2017 asking the petitioner to attend the enquiry before the 5th respondent. Learned counsel for the petitioner submits that the petitioner requested for documents vide his representation dated 28.03.2017, but, without supplying the same the respondent authorities are going ahead with the enquiry and that the petitioner will not be able to participate without the help of documents sought for. On the other hand Smt.
Bobba Vijayalakshmi, learned Standing Counsel appearing for respondents 3 to 5 submits that after filing of representation by the petitioner seeking documents, the 4th respondent issued proceedings dated 07.06.2017 permitting the petitioner to verify the connected records pertaining to the subject matter before Sri Ch.Lakshmi Narayana, Deputy general Managar (FAC) and to submit his explanation within 15 days. She also submits that the documents sought for by the petitioner are voluminous and not relevant to his case.
It is to be seen that as the respondents have already considered the representation of the petitioner dated 28.03.2017
and issued proceedings dated 07.06.2017 permitting the petitioner to verify the connected records, the petitioner should not have any grievance for verifying the records and submitting his explanation as directed by the 4th respondent in the letter dated 07.06.2017. In view of the same, it is open for the petitioner to verify the records as permitted in the letter dated 07.06.2017 and file explanation within a period of four weeks from today. On such explanation being filed by the petitioner, the respondent authorities may take appropriate action, in accordance with law. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
