THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11033 OF 2017 ORDER:

Petitioner states that, originally, he was granted 2-B licence for running Bar and Restaurant under the name and style of 'Yelamuri Restaurant and Bar' at D.No.204, Ward No.16, Tirupathi. On account of restrictions imposed by the government, in terms of Section 72 of the A.P.Excise Act, 1968, petitioner made an application seeking shifting of 2-B licence premises to premises at D.No.13-5-531/B, Tatanagar, 11th Division, Tiruptahi. The grievance of the petitioner is that, while the applications of similarly situated persons were already considered, no decision has, as yet, been taken on his application. Hence the Writ Petition.

Heard the learned Government Pleader for Prohibition and Excise (AP).

Considering the fact that the petitioner had already made an application on 10.03.2017 for shifting of 2-B licence premises to new premises, respondent No.2 shall, duly taking into consideration Rules 4, 25 and 28 of the A.P. Excise (Grant of Licence of Selling by shop and conditions of licence) Rules, 2012, pass appropriate orders, within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is disposed of accordingly. No costs. Miscellaneous petitions pending, if any, shall stand closed.
