SMT JUSTICE T.RAJANI CRIMINAL PETITON No.400 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.53 of 2017 on the file of Tharigoppula Police Station, Jangaon District. The offences alleged are under Sections 306, 506, 323, 290 r/w 34 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The public prosecutor brings to the notice of this Court that this Court, by virtue of the earlier order in Crl.P.No.12485 of 2017, dismissed the anticipatory bail application filed by the petitioner and a perusal of the said order shows that the court considered the merits of the case and declined to grant anticipatory bail to the petitioner, while granting bail to the accused No.2.

Hence, in view of the fact that the petition is already dismissed on merits, this Court cannot entertain this petition. 5.
Accordingly, the Criminal Petition is dismissed.
However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The
court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day.
