JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION NO.429 OF 2022 O R D E R:- This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/accused in the event of his arrest in connection with Crime No.5209 of 2021 of P.S., Vigilance & A.P.T.S., Ranga Reddy District, registered for the offence punishable under Section 135(1)(a) of the Electricity Act, 2003.

The case of prosecution is that the petitioner was found tapping electricity to his house by means of a wire of 4 meters and caused loss to a tune of Rs.3,482/- to TS TRANSCO by connecting the pilferage energy to a load of 2290. Further, the petitioner is utilized supply from near by L.T. over head lines by means of a PVC insulted black colour aluminum wire, though he has domestic service connection.

Heard Mr.P. Animi Reddy, learned counsel for the petitioner, and learned Assistant Public Prosecutor for the respondent-State. 4.
Learned counsel for the petitioner submits that the petitioner is innocent and he has not committed any offence as alleged in the complaint. He submits that due political rivalry between the petitioner and the local leaders, he has been implicated in this case falsely. The petitioner has nothing to do with the alleged offence. He submits that the petitioner has
paid the entire amount of Rs.2,290/-. Hence, his case may be considered for grant of pre-arrest bail.

Taking into consideration the fact that the petitioner has already paid the entire amount, this Court deems it appropriate to grant pre-arrest bail to the petitioner/accused.

Accordingly, this Criminal Petition is allowed. Petitioner/accused shall surrender before the Station House Officer, Vigilance and A.P.T.S., P.S., Ranga Reddy District, in connection with Crime No.5209 of 2021 within one week from today and on such surrender and executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he shall be released on bail. It is made clear that no further extension of time will be granted.
