HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.1395 of 2018 ORDER:

Heard learned counsel for the petitioners and also learned Government Pleader for Municipal Administration for respondent No.2 and by recording offer to file vakalat by Sri M.Balaji, learned Standing Counsel for the 1st respondent, Municipal Corporation and perused the prayer in the writ petition with the supporting affidavit and from the notice dated 13.11.2017 issued by the 1st respondent Municipality giving options to the petitioners to opt any one of their recourse for taking site of the petitioners for road widening, for which they did not incline. Thereby, the respondents cannot interfere with the private property of the petitioners and cannot dispossess them, except by following due process of law. Having regard to the above and in the result, the Writ Petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
