HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.520 OF 2020 ORDER:
This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused seeking to quash the proceedings in Crime No.402 of 2019 of P.S. Khanapuram Haveli, Khammam District, registered for the offences punishable under Sections 270 and 273 of the Indian Penal Code. Heard the learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the respondent-State and perused the record.
Learned counsel appearing for the petitioner/accused would submit that in similar circumstances this Court vide common order, dated 27.08.2018, in Crl.P.No.3731 of 2018 and batch, quashed the proceedings against the petitioners therein for the offences punishable under Sections 270 and 273 IPC while permitting to proceed with for the offence punishable under Section 20(2) of the Cigarettes and other Tobacco Products Act, 2003. Learned Additional Public Prosecutor does not dispute the same.
Following the said order and for the reasons stated therein, this Criminal Petition is also allowed quashing the proceedings in Crime No.402 of 2019 of P.S. Khanapuram Haveli, Khammam District, against the petitioner/accused for the offences punishable under Sections 270 and 273 IPC.
