THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.1566 OF 2019 O R D E R :

This writ petition is filed seeking a writ of mandamus to declare the action of the respondents in not allowing the petitioner to perform the duties of the community surveyor even though the petitioner made representations on 09.09.2015 and 22.03.2018 and terminating the services of the petitioner orally without issuing any notice as arbitrary, illegal, violative of principles of natural justice and violative of Article 14 and 16 of the Constitution of India and sought for a consequential direction to direct the respondents to consider the representations submitted by the petitioner on 09.09.2015 and 22.03.2018 and allow the petitioner to perform the duties.

Heard Sri G.Madhusudhan Reddy, learned counsel for the petitioner and learned Government Pleader for Services-II. It has been contended by the petitioner that he was appointed as community surveyor with the respondents and he has been discharging his duties without any complaint. Petitioner further contends that his services were discontinued without assigning any reason on 12.12.2014. Moreover, petitioner has been requesting the respondents to re-engage him as community surveyor through representations dated 09.09.2015 and 22.03.2018. The grievance of the petitioner is that the respondents are neither passing any orders on the representations submitted by him nor considering his request for re-engaging him as community surveyor.

Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner on 09.09.2015 and 22.03.2018 and pass appropriate orders. Learned Government Pleader for respondents contends that the case of the petitioner would be considered and appropriate orders would be passed on the representations submitted by the petitioner in accordance with law.

This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioner on 09.09.2015 and 22.03.2015 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of copy of this order.

With the above observations, the writ petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
