THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12602 of 2003 ORDER:

This writ petition is filed seeking the following relief: " To issue an order, direction or a writ one in the nature of Mandamus declaring the action of the respondents in denying the payment of 50% more compensation on par with the 2nd batch of employees who retired under Circular No.81/2001, dated 5.12.2001 as illegal, arbitrary, discriminatory and violative of Article 14 of the Constitution of India and Clause 4 (3) of Circular No.81 of 2001, dated 05.12.2001 is also applicable to the petitioners who retired under Circular No.71 of 2000, dated 4.12.2000 and circular No.80 of 2000, dated 26.12.2000, as the Wage Revision due as on 01.01.1997 has not been effected by the respondents, the petitioners are legally entitled for payment of 50% more compensation on par with the 2nd batch of employees who retired under Circular No.81/2001, dated 5.12.2001 and consequently direct the respondents to pay the petitioners 50% more compensation on par with the 2nd batch of employees who retired under Circular No.81 of 2001, dated 5.12.2001 forthwith."

Heard Sri A.Srinivasa Sarma, learned counsel for the petitioners and Sri D.Ravishankar Rao, learned Standing Counsel for the respondents.

Learned counsel for the petitioners as well as learned Standing Counsel had fairly conceded that the relief sought for in the writ petition cannot be granted in view of the Judgment, dated 22.5.2003 passed by

the Hon'ble Supreme Court in the case of Vice Chairman and Managing Director, A.P. SIDC Ltd., Vs. R.Varaprasad1.

In view of the above submission, the writ petition is dismissed as infructuous.

Miscellaneous petitions pending if any, shall stand closed. No costs.
