THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38145 of 2015 ORDER:
The prayer of the petitioner in this case is as under: "It is therefore prayed that this Hon'ble Court may be pleased to issue a writ or order or direction more particularly one in the nature of mandamus declaring the action of the respondents 2 and 3 in interfering in civil disputes and also insisting that not to enter into the petitioner's land in Sy.No.306 an extent of 1089 Sq.Yds. situated in Markapur Municipality, Prakasam District and further calling the petitioner to the 3rd respondents P.S. is arbitrary and illegal and consequently direct the respondents 2 and 3 not to interfere in civil disputes and not to interfere while entering into the petitioner land and pass such other order or orders may deem fit and proper in the circumstances of the case."
The Sub Inspector of Police, Markapur Town Police Station, Prakasam District, filed a counter-affidavit stating that a civil suit was pending before the competent Court in relation to the dispute between the parties and the police authorities were not concerned therewith. The allegation made by the petitioner as to interference by the police authorities in such civil disputes was denied as false and baseless. The Sub Inspector further stated that Crime No.40 of 2014, which had been registered upon the complaint made by the petitioner, was referred as civil in nature.
In the light of the aforestated counter-affidavit averments, which are duly taken on record, no adjudication is warranted on merits in this writ petition.
Ms.Pulipati Radhika, learned counsel for the petitioner, is also agreeable to the disposal of the writ petition recording the stand of the police authorities.
The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
