THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3080 and 3494 OF 2000 COMMON ORDER:

Both these writ petitions are being disposed of by this Common Order as they relate to the challenge made against the action of the 3rd respondent - General Manager, Nagarjuna Grameena Bank, Head Office at Khammam, in promoting certain respondents by ignoring the petitioners' claim to the said posts. When the matter is taken up for hearing, learned counsel for the respondents, as well as, the petitioners fairly submit that the issue involved in these Writ Petitions, is squarely covered by a Full Bench judgment of this Court in W.A.No. 685 of 1995 and Batch, dated 26.11.1998.

Recording the said submission, these Writ Petitions are allowed in terms of the judgment in W.A.No.685 of 1995 and Batch, passed by a Full Bench of this Court on 26.11.1998. However, it is to be noted that as of now it is possible that except 4th petitioner in W.P.No.3494 of 2000 all other petitioners would have retired from service by this time. In those circumstances, since the issue was in relation to promotions to higher post and the writ petitions are of the year 2000, the promotions shall be reckoned notionally from the date of filing of the Writ Petitions and the consequential monitory benefits, if any, shall be given to the petitioners. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in these Writ Petitions shall stand closed.
