The present writ petition is filed questioning the action of the 3rd and 4th respondents in calling upon the petitioner to attend the 3rd respondent - Police Station, time and again, along with children in the name of counselling basing on the complaint alleged to have been lodged by the 5th respondent, except following the due process of law. 2.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 24.01.2019, submits that on receiving complaint from the 5th respondent, on 14.11.2019, the 3rd respondent made an entry in the General Diary and since it is the matrimonial issue, called the petitioner to the police station for counselling, upon which, the petitioner attended the counselling on 24.12.2019 and 20.01.2020. Since the counselling failed, a case in Crime No.8 of 2020 was registered for the offences punishable under Sections 498-A, 323 and 506 IPC on the file of the IT Corridor Police Station, on 23.01.2020, wherein the petitioner herein is arrayed as accused No.1 in the said case. 4.

In view of the fact a case is now registered against the petitioner based on the complaint of the 5th respondent, the authorities shall act in accordance with law in investigating into the above case.

Subject to the above observation, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
