THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY WRIT PETITION No.25559 of 2008 ORDER:

This writ petition under Article 226 of the Constitution of India is filed by the petitioners seeking the following relief: " .... declaring the action of the respondents in not processing the applications submitted by the petitioners in relation to the plots covered under the Sale Deeds vide Document NOs.4038/85, dt.6.6.1985, 8602/85, dt.23.12.85, 8581/85, dt.20.12.85, 3977/85, dt.3.6.85, 3987/85, dt.27.5.85, 8583/85, dt.20.12.85, 7433/85, dt.5.11.85, 8365/85, dt.13.12.85, 8582/85, dt.20.12.85 respectively under GOMs.No.166, dt.16.2.2008 as illegal, arbitrary and further direct the respondents to consider the applications submitted by the petitioners in the light of the said GO ...."

2) Heard. Perused the record.

3) Even though the matter pertains to the year 2008, the respondents have not filed their counter till date, in spite of the specific direction issued by this Court on 21.11.2019, the learned Government Pleader has not obtained necessary instructions with regard to the status of the applications filed by the petitioners.

4) Having gone through the record, it is to be noted that the main grievance of the petitioners is that the land in which plots purchased by them under various registered sale deeds is

an assigned land and by way of abundant caution the petitioners applied to the Government for regularizing their possession under G.O.Ms.No.166, dated 16.02.2008.

5) Having regard to the facts of the case, the ends of justice will be met if the Writ Petition is disposed of with a direction to the official respondents to dispose of the applications if any submitted by the petitioners in terms of G.O.Ms.No.166, dated 16.02.2008, if the same are still pending consideration, within a period of two months from the date of receipt of a copy of this order. In case, the respondents have already disposed of the said applications, they shall communicate a copy of the order to the writ petitioners forthwith and the writ petitioners are free to challenge the said decision, if they are so aggrieved. Pending consideration of the said applications, status quo shall be maintained by both the parties in respect of the subject land.

Accordingly, the Writ Petition is disposed of. As a sequel, miscellaneous petitions pending in this writ petition, if any, shall stand closed. No orders as to costs. ________________________ A.ABHISHEK REDDY, J 06.12.2019.
