CVNR, J CC 789/2017 ORDER:
This contempt case is filed alleging wilful disobedience of order dt.01.09.2015 in W.P. No.18900 of 2015.
At the hearing, it is represented by Mr. N. Jayasurya, learned counsel for the respondent, that in compliance with the order of this Court the respondent has in all paid a sum of Rs.7,79,136/-, which, according to him, is due and payable to the petitioner. Mr. M. Pitchaiah, learned counsel for the petitioner, while admitting that the said amount was paid, however, claimed that his client is still entitled to receive more than Rs.2,00,000/- and that so far the respondent has not forwarded the pension papers of the petitioner to the Regional Provident Fund Commissioner.
As regards the dispute relating to the quantum of the amount payable to the petitioner, in my opinion, he is entitled to avail a fresh legal remedy, as the aspect of calculation regarding the quantum of amount does not fall within the scope of this contempt case. With regard to the grievance of the petitioner regarding non forwarding of the pension papers of the petitioner, the learned counsel for the respondent has undertaken that his client will forward the pension papers to the Regional Provident Fund Commissioner within four weeks from today. This undertaking is placed on record.
The contempt case is accordingly closed.
