H.No.4-7156161D13, Pandu Ranga Nagar Colony, Adjacent to HUDA Colony Attapur, Hyderabad - 500 048 Respondents WHEREAS the Petitioner above named through his Advocate SRI J P RAO presented this Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order or Writ more particularly Writ of Mandamus declaring the silence and in action of the Respondent No. 2 and 3 to the complaint made by the Petitioner on 5.11.2019 and 6.11.2019 respectively as unaccountable and bad adminishation and allowing the unofficial respondents No.4 and 5 to construct the house in Premises No.H.No.
4-7-156i6lD/3 Pandu Ranga Nagar Colony, Attapur, Hyderabad without following the rules of Set backs as illegal and consequently direct the respondent No.2 and 3 to take action against the Unofficial Respondents as per rules in force; AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and the orders of the High Court dated 2710112020 & 0310212020 made herein and upon hearing the arguments of Sri J P RAO Advocate for the Petitioner, directed issue of notice to the Respondents herein to show cause as to why this WRIT PETITION should not be admitted.

THE COURT MADE THE FOLLOWING ORDER:

Learned counsel for the petitioner is directed to take out personal notice to respondent Nos.4 and 5 and file proof of service into the Registry. The learned Standing Counsel, on instructions, has stated that since the unofficial respondent Nos.4 and 5 have made unauthorized constructions, the official respondents have already issued notices to them under Sections 452 (21 and 461 ofthe Greater Hyderabad Municipal Corporation Act, 1955. Having regard to the fact that the official respondents have already issued demolition notices to respondent Nos.4 and 5, the official respondents are directed to pass necessary orders thereon, strictly in accordance with law, duly giving a logical conclusion. ln case respondent Nos.4 and 5 do not cooperate, the official respondents shall take necessary action, and file an'Action Taken Report' before this Court by the next date of hearing. Post on 16.08.2021.
