This writ petition is filed to declare the action of the 3rd respondent in sending the police officials to the petitioners' house and directing them to appear before the said respondent and compelling the petitioners to compromise with the 4th respondent in civil cases, i.e., C.C.C.A.No.288 of 2017 and A.S.No.1031 of 2012, pending before this Court, failing which, threatening the petitioners to implicate in criminal cases, thereby interfering in the personal life and liberty of the petitioners, as illegal and arbitrary.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 27.01.2020, a copy of which is placed on record of the Court, whereby the 3rd respondent has denied the interference into the life and liberty of the petitioners, and the allegation of the petitioners, that they are being detained in the police station and being compelled to compromise with the 4th respondent in civil cases, i.e., C.C.C.A.No.288 of 2017 and A.S.No.1031 of 2012, pending before this Court, as baseless and far from truth. By the said written instructions, it is also stated that, upon receiving a private complaint, the respondents have registered a case in Crime No.122 of 2019 dated 22.02.2019 for the offences under Sections 447, 504 and 506 IPC and Section 156(3) Cr.P.C., on the file of the 3rd respondent, against the petitioners and investigation has been taken up in the matter. It is further stated that during the course of investigation, the

complainant has been examined and recorded his detailed statement and issued notice under Section 91 Cr.P.C. to the complainant asking him to produce relevant documents for the purpose of investigation. Learned AGP further stated that except conducting investigation into the crime registered, the 3rd respondent did not harass or interfere with the property, life and liberty of the petitioners, as alleged. 4.

Having regard to the above assertion made on behalf of the respondents by the aforestated written instructions, no further orders need be passed in the present writ petition, except observing that the respondents shall act in accordance with law while investigating into Crime No.122 of 2019.
