THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1397 OF 2018 O R D E R:

This writ petition is filed challenging the action of respondent No.2 in not providing electricity supply to the petitioner-firm situated in Survey No.277, Ward No.19, RTPP Road, Rameshwaram Village, Somulavaripalle Gram Panchayat, Proddatur Mandal, YSR Kadapa District.

The grievance of the petitioner is that in spite of complying with all the requisite formalities, the respondents are not providing electricity supply to its firm.

Heard the learned counsel for the petitioner. None appears for the respondents.

It may be noted that a duty is cast on the licensing authority in terms of Section 43 of the Electricity Act to supply electricity except in cases where the supply is unable to be affected in terms of the exceptions provided under Section 44 of the said Act. In those circumstances, the respondents have failed in their duty to supply electricity connection to the petitioner-firm. Hence, the writ petition is allowed with a direction to the respondents to provide electricity supply to the petitioner-firm, within a period of two weeks from the date of receipt of a copy of this order.
