HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.1635 of 2019 ORDER:
This writ petition is filed seeking a Writ of Mandamus declaring the action of the 2nd respondent in issuing proceedings dated 25.09.2018 contrary to the orders passed by this Court in W.P.No.19377 of 2018 and not disposing of the representation filed by the petitioner on 14.12.2018 as illegal and arbitrary and sought a consequential direction to direct the respondents to dispose of the representation filed on 14.12.2018.
Heard Mr.M.Ramgopal Rao, learned counsel for petitioner and the learned Government Pleader for Services-I. It has been contended by the petitioner that he is working as Gazetted Headmaster Gr.II at Government High School, Sanathnagar. The grievance of the petitioner is that his case was not properly considered in the transfer counselling conducted by the respondents during the academic year 2018-19. The petitioner has submitted representation on 14.12.2018, but so far, the respondents have not disposed of the said representation nor considered his case for posting nearer to his spouse working place. Learned counsel for petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation filed by the petitioner on 14.12.2018 and pass appropriate orders.
Learned Government Pleader appearing for respondents has contended that the representation of the petitioner will be
considered and appropriate orders would be passed in accordance with law.
This Court, having considered the submissions made by the learned counsel for the parties, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 14.12.2018 and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is disposed of. No order as to costs.
