HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6322 of 2017 ORDER:

This writ petition is filed against the order passed by the 5th respondent rejecting the application of the petitioner for grant of pattadar pass books and title deeds without assigning any reasons by merely stating the word 'rejected'. Heard learned counsel for the petitioner who states that without issuing any notice and without giving any reasons, the impugned order has been passed, as such, the petitioner filed one more application dated 05.12.2016 for reconsideration of the same.

Heard learned Assistant Government Pleader for Revenue. A perusal of the impugned proceedings filed by the petitioner goes to show that the respondent rejected application of the petitioner by endorsing a word 'rejected' on the said application. It also appears that no notice or opportunity was given to the petitioner as envisaged under Section 5(1) of the A.P.Rights in Land and Pattadar Pass Books Act, 1971. In view of the above, the impugned order passed by the 5th respondent is set aside and the 5th respondent is directed to consider the application of the petitioner afresh and pass orders, in accordance with law, after issuing notice and affording opportunity of hearing to the petitioner.

Accordingly, the writ petition is allowed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 02.03.2017 tk
