Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed therein, the High Court may be pleased to release the petitioner on bail in Crime No. 265 of 2017 on the file of the Police Station, Dornakal, Mahabubabad District (Warangal);
The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri A. Prabhakar Rao, Advocate for the Petitioner and of Public Prosecutor(TS) on behalf of RespondentState, the Court made the following ORDER :- "This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused, in Crime No.265 of 2017 on the file of the Station House Officer, Dornakal Police Station, Mahabubabad, Mahabubabad District. 2.
The offences alleged are under Sections 363, 376(2)(i)(n) of I.P.C. and Section 11 R/w.12, (5)(1) R/w.6 of the Prevention of Children from Sexual Offences Act, 2012 and Section 9 of the Prohibition of Child Marriage Act, 2006. 3.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.
Learned counsel for the petitioner submits that the 164 Cr.P.C. statement of the victim girl shows that the accused is not at all involved in this case. However, a perusal of the same, which is furnished to this Court, would show that there was a galata between the accused and the mother of the victim girl, and the same was taken before the elders, and the elders took her signatures on white papers.

Hence, from the above, it appears that a false case is foisted against this petitioner.

Hence, in the above circumstances, this Court opines that this is a fit case for grant of bail to the petitioner. Accordingly, the Criminal Petition is allowed. The petitioner/accused is directed to be enlarged on bail, on condition of his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate at Mahabubabad, Mahabubabad District.
