THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Petition No. 1385 of 2018 Order: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The relief sought for in this Writ Petition, filed by two doctors working in Primary Health Centres in Khammam and Jayashankar Bhoopalapally Districts, is to declare the action of the respondents, in not counting their service from 19.1.2012 to 7.9.2013, and 25.6.2012 to 31.3.2014, as Medical Officers (Contract basis) for the purpose of giving weightage marks for selection and appointment to the post of Civil Assistant Surgeons, pursuant to the notification dated 8.12.2017, as illegal and arbitrary.

While weightage was sought to be given for services rendered, on contract basis, within the State of Telangana, no weightage of marks was hitherto provided for services rendered by contract Medical Officers in the present State of Andhra Pradesh, even if such service related to a period prior to bifurcation on 2.6.2014. The petitioners' claim that, since the State of Telangana came into being only on 2.6.2014, the services rendered by the petitioners, in the erstwhile State of Andhra Pradesh prior to 2.6.2014, should also to be reckoned while granting weightage of marks for the ensuing selection and appointment to the posts of Civil Assistant Surgeons.

When the matter came up earlier, learned Advocate General for the State of Telangana informed us that the matter was under consideration, and he would be in a position to inform this Court, by the next date of hearing, regarding the decision which the Government intends taking in this regard. Today the learned Advocate General for the State of Telangana would fairly state that the services of eligible

candidates, rendered in the erstwhile State of Andhra Pradesh before 2.6.2014, would also be reckoned for the purpose of granting weightage of marks for the ensuing selection and appointment to the posts of Civil Assistant Surgeons.

Sri M. Surender Rao, learned Senior Counsel appearing on behalf of the petitioners, would submit that, in the light of the assurance given by the learned Advocate General for the State of Telangana, the cause in the Writ petition no longer survives. Recording the submission of the learned Advocate General for the State of Telangana that weightage of marks, for services rendered prior to 2.6.2014 in the erstwhile State of Andhra Pradesh, would be given weightage to eligible candidates for the ensuing selection and appointment to the posts of Civil Assistant Surgeons, the Writ Petition is closed. Miscellaneous Petitions pending, if any, shall also stand closed.
