As there was no representation for the sole appellant, which is a Trust, twice on 31.08.2016 and 01.09.2016, the matter was directed to be listed under the caption "FOR DISMISSAL". Even earlier thereto, on three consecutive occasions, at request of the learned counsel for appellant, the matter was adjourned, so as to seek instructions from the appellant.

Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.

Hence, the appeal is dismissed for non-prosecution. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
