HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.4951 of 2012 ORDER :
This writ petition is filed seeking the following relief :- " ...... to issue a writ or order or direction, especially one in the nature of Writ of Mandamus (i) declare the Proceeding No.CRP/ MED/ B/ 4/ 1003/ 64 dated 10.03.2011 issued by the 2nd respondent as illegal and arbitrary (ii) consequently direct the respondents to release petitioner's medical reimbursement of Rs.2,09,173/ - duly granting all other consequential benefits....." . Heard Sri K.Vasudeva Reddy, learned counsel for the petitioner and Sri Nandigama Krishna Rao, learned Standing Counsel for the respondents.
It has been contended by the petitioner that he was initially appointed as a Badli Filler on 30.07.1988 and subsequently promoted as a Clerk during September, 2009. While discharging his duties as such, the petitioner got chest pain during December, 2010 and he took treatment in Yashoda Hospital, Somajiguda, Hyderabad, and incurred an amount of Rs.2,09,173/ - towards medical expenditure. The petitioner has submitted a representation to the respondents to release amount incurred towards medical expenses. But, the respondents have rejected the request of the petitioner vide proceedings dated 10.03.2011. Challenging the same, the present writ petition is filed.
Learned counsel for the petitioner submits that as per the Rules, though the petitioner is entitled for medical reimbursement, the respondents have erroneously rejected the case of the petitioner. Therefore, appropriate orders be passed in the writ petition directing
the respondents to release the amount of Rs.2,09,173/ - towards medical reimbursement in favour of the petitioner. The learned Standing Counsel appearing for the respondents submits that after rejection of the case of the petitioner on 10.03.2011, the petitioner has submitted another application on 25.04.2011 and the respondents would consider the said representation and pass appropriate orders in accordance with law.
This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 25.04.2011 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. With the above observations, this writ petition is disposed of. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
