THE HON'BLE SRI JUSTI CE SURESH KUMAR KAI T CRLP.NO.1 6 5 5 6 OF 2 0 1 6

O R D E R

Vide the present petition petitioner/ A-8 seeks to enlarge him on bail in the event of his arrest in Crime No.419/ 2016 on the file of Police Station Pahadishareef, Cyberabad, registered for the offences punishable under Sections 120-B read with 302 IPC. On 6.12.2016, the learned counsel for the petitioner submitted that petitioner has no acquaintance with the other accused and is in no way connected with the crime and that he has been falsely implicated in the offence. In view of the said submission, the learned Additional Public Prosecutor was directed to verify the call details of the petitioner, whether he has made calls to any of the other accused before crime or during or after crime and also his phone location at the time of commission of the alleged offence.

The learned Additional Public prosecutor produced calls details of the petitioner on the date of alleged commission of the offence on 19.9.2016. On a perusal of the call details, it is found that the petitioner/ A-8 made two calls on the said date to A-2 at 5.35 p.m. and 6.48 p.m. Thus the petitioner seems to have been involved in the present crime. To unearth the true facts, custodial interrogation may be required.

Therefore, I do not find any ground to grant anticipatory bail and the petition is accordingly dismissed.
