THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.13629 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against petitioners/accused Nos.2 to 4 in F.I.R. No.102 of 2016 of GDK-II Town Police Station, Karimnagar District, registered for the offence punishable under Sections 498-A, 506, 354(A) I.P.C. and Sections 3 and 4 of Dowry Prohibition Act. Heard and perused the material available on record. It is represented that even though petitioners/accused Nos.2 to 4 obtained bail and charge-sheet was also not filed, the petitioners/accused Nos.2 to 4 are being asked by the Court below to appear on each and every date of hearing In that view of the matter, the learned Magistrate concerned is directed not to insist the presence of petitioners/accused Nos.2 to 4, unless charge-sheet is filed and summons are issued to them.

The learned Magistrate concerned shall obtain the bond from petitioners/accused Nos.2 to 4 to appear before the Court on being charge-sheet filed. Accordingly, the Criminal Petition is disposed of.
