HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19786 of 2012 ORDER:

As there was no representation on behalf of the petitioner on 21.09.2015, the matter was directed to be listed today under the caption "for dismissal". In spite of the matter being posted under the caption "for dismissal" even today also there is no representation on behalf of the petitioner either in the morning session or in afternoon session. Hence, heard learned Government Pleader for Land Acquisition and perused the record.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to taken over the petitioner's land admeasuring 205.33 square yards situated in Sy.Nos. 11/23, 11/27 and 11/29 (formerly Sy.No.11) of Lakshkersingaram Revenue Village, Vidyaranyapuri, Hanamkonda, Warangal District, without following due process of law, as illegal, arbitrary and violative of principles of natural justice. When the matter is taken up for hearing the learned Government Pleader for Land Acquisition placed on record the instructions received by him from the Tahsildar, Hanamkonda, wherein it is mentioned that the land which is subject matter of dispute in this writ petition is inam land and the respondents have neither repossessed the land nor ordered for construction of school building etc.

It is further stated that they are not interfering with the land in question. Without going into the merits of the case and in view of the representation made by the Government Pleader the writ petition is disposed of directing the respondents to follow the due process of law if the land is taken for any public purpose. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
