HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1835 OF 2017 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the respondents 2 to 4 and their subordinates in undertaking survey and marking activities in the lands of the petitioners in Survey Nos.312, 316 and 322, respectively in Gudimalla Revenue Village, Khammam Rural (M), Khammam District, without issuing any notice and without following due process of law, as illegal and arbitrary and for a consequential direction to the respondents 2 to 4 and their subordinates not to interfere with the possession and enjoyment of the petitioners in any manner, in respect of their lands without considering the alternate proposals available for laying of bypass road in NH 365-A between Gurralapadu to Venkatapuram.
This Court on 30.01.2017 has granted interim order. Sri S.S.Verma, learned Standing Counsel for the 5th respondent on instructions submits that they will follow due process of law before acquiring any land belonging to the petitioners.
Recording the aforesaid submission made by the learned standing counsel, the writ petition is disposed of directing the respondents not to interfere with the possession
of the petitioners over the subject land, without following due process of law. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
