Bose for the revision petitioner and Mr. G. Eshwaraiah holding for Mr. B.Sriram Kartik. The request of revision petitioner-defendant to amend the written statement by correcting the name of the defendant as "Nama" from "Namala" is rejected by the trial Court. Hence, the Civil Revision Petition. This Court is of the view that the trial Court having recorded a finding that the amendment does not have serious bearing on the main issues in the Suit, ought to have allowed the application. The request for amendment in written statement from "Namala" to "Nama" made through I.A. No. 1160 of 2010 is ordered.

It is made clear that the amendment is accepted at the instance of defendant/revision petitioner. All the contentions pending upon in this behalf for plaintiff/respondent are to be considered on its own merits. The Civil Revision Petition is ordered, as indicated above. Consequently, pending miscellaneous applications shall also stand closed. No costs.
