THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.378 of 2019 ORDER:

This petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/accused seeking to relax the conditional order, dated 10.01.2019, passed in Crl.M.P.No.22 of 2019 in Crl.A.No.18 of 2019 on the file of Additional Metropolitan Sessions Judge for Trial of Communal Offences Casescum-VII Additional Metropolitan Sessions Judge, Hyderabad, requiring the petitioner/accused to deposit 10% of the compensation amount awarded in C.C.No.231 of 2017 on the file of VII Special Magistrate, Hyderabad.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor appearing for the 1st respondent-State and perused the record.

Learned counsel for the petitioner/accused would submit that as the petitioner/accused has sustained huge loss in business, he is unable to pay 10% of the compensation amount as directed by the learned Sessions Judge and ultimately, prayed to reduce the same. 4.

The request made by the petitioner/accused before this Court can as well be made before the Court below, which imposed the condition to pay 10% of the compensation amount, by filing an appropriate application. Therefore, there is no merit in the petition. 5.

With this observation, this petition is disposed of. Miscellaneous Petitions, if any, pending in this petition shall stand closed.
