This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking his enlargement on bail in connection with Crime No.01/RCT-ACB-MDK/2026 of ACB, Medak Range, Sanga Reddy District. The offences alleged against the petitioner are under Section 7 (a) of Prevention of Corruption Act.

The facts of the case are that on 19.12.2025 the complainant lodged a complaint before ACB officials stating that the petitioner herein demanded a bribe of Rs.30,000/- and accepted Rs.20,000/- for deleting the name of complainant in Cr.No.508 of 2025 of Kollur Police Station, which was registered for the offences under Section 318(4) of BNSS and Section of Essential Commodities Act. After verification of the genuineness in the complaint, antecedents of the petitioner and the complainant, case was registered against the accused for the above offences.

Heard Sri G.Anil Kiran Kumar, learned counsel appearing on behalf of the petitioner as well as Sri T. Bala Mohan Reddy, learned Standing Counsel-cum-Special Public Prosecutor for ACB appearing on behalf of the respondent.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. He is falsely implicated in this case due to animosity of the complainant towards the petitioner for strictly performing his official duties, as case was registered against the complainant and others for illegally transporting the ration rice in the lorry. The complainant is the owner of the said lorry. The entire
- 3 - investigation in this case is completed and the material evidence and the documents are in the custody of ACB. Petitioner is ready to cooperate with the investigation and shall abide by any conditions that may be imposed by this Court. Hence, prayed this Court to grant regular bail to the petitioner. 5.
On the other hand, learned Standing Counsel opposed bail contending that the petitioner herein was caught red handedly while accepting the bribe amount of Rs.20,000/-. The investigation is at initial stage and the statement of the complainant and other witnesses under Section 183 of BNSS is yet to be recorded and crucial documents are to be collected. If petitioner is released on bail, he may tamper the evidence and threaten the witnesses. Hence, petitioner is not entitled for bail at this stage and prayed to dismiss this petition. 6.
Considering the submissions made by both the counsel and material on record, petitioner is in jail from 03.01.2026. Most of the investigation is already completed except filing of charge sheet and further recording of statement of the complainant is scheduled to be recorded on 06.02.2026, Considering all these circumstances and the period of
- 4 - incarceration of petitioner, this Court deems it fit to grant regular bail to the petitioner subject to the following conditions : i. The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Special Judge for SPE & ACB Cases at Nampally, Hyderabad.
ii. The petitioner/Accused shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii. The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of the BNSS. 7.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
