HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Tr.C.M.P.No.14 of 2019 ORDER:

This Tr.C.M.P. is filed to transfer F.C.O.P.No.346 of 2017 from the file of the Family Court Judge of Warangal to the Family Court at Karimnagar.

Notice in this Tr.C.M.P. was ordered to the respondent and it was returned with endorsed "unclaimed". Therefore, notice is deemed to be served on respondent.

The said O.P. was filed by respondent against the petitioner seeking conjugal society of petitioner along with children born to them.

Petitioner contends that respondent was harassing the petitioner and also demanding additional dowry and she is staying with her parents at Karimnagar. She also alleged that she went to the house of respondent to join the respondent, but the respondent and his family members sent her back to her parents' house and she filed complaint under Section 498-A I.P.C. and Section 4 of D.P.Act. She also stated that she filed M.C.No.16 of 2017 before the Family Court at Karimnagar and also D.V.C.No.69 of 2017 before the I Additional Judicial Magistrate of First Class, Karimnagar. She contended that she finds it difficult to travel to Warangal from Karimnagar to attend

MSR,J Tr.C.M.P.No.14 of 2019 F.C.O.P.No.346 of 2017, which is pending before the Family Court, Warangal.

Since no counter-affidavit is filed by respondent refuting these contentions and since petitioner is residing at Karimnagar and had also filed M.C.16 of 2017 and D.V.C.No.69 of 2017 in the Courts at Karimangar and since she also has to take care of her minor children, I deem it appropriate to transfer F.C.O.P.No.346 of 2017 on the file of the Family Court, Warangal to the Family Court at Karimnagar. 6.

The Tr.C.M.P. is allowed as above. No costs. 7.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
